Analysis of a Used Car Transaction

A person buys a used car from a private seller. The sales contract documents the transfer of ownership and the agreed price, but it does not and cannot specify the full history and every potential mechanical issue with the vehicle. The seller is aware of a recurring, but difficult to diagnose, transmission problem but does not disclose it. Two months after the purchase, the buyer faces a costly transmission repair. Analyze this transaction by explaining how the information gap between the buyer and seller leads to a contractual failure, and how this failure results in an uncompensated cost for one of the parties.
