Analysis of Negotiating Power and Outcomes

A freelance software developer is negotiating a contract with a large tech company.

  • In Year 1, the developer is just starting their career, has no other job offers, and needs the income to cover basic living expenses. The company offers a contract with a low hourly rate, which the developer accepts.
  • In Year 2, the developer has gained significant experience and has two other lucrative contract offers from competing firms. The same tech company wishes to hire them for a similar project. The developer is able to negotiate a contract with a much higher hourly rate and more flexible working hours.

Evaluate the two outcomes from the perspective of both the developer and the company. Analyze the key factor that shifted the negotiating power between Year 1 and Year 2, and discuss how this change is reflected in the final contract terms.
