Limitations of Legal Liability in Practice

While laws that make reckless drivers financially responsible for damages are designed to influence behavior by making them 'internalize an externality,' this mechanism is not always perfectly effective. Critically evaluate this legal approach by discussing at least two distinct real-world conditions under which this system might fail to adequately alter a driver's behavior or fully address the harm caused.
