A study of childhood trauma and dissociation analyzed borderline personality disorder and its connection to criminal behavior later exhibited as an adult. A young murder defendant who experienced multiple forms of traumatic events had undergone standardized assessments, and it was discovered that there was a high risk of recidivism for criminal behavior  and social dangerousness based on his dissociative state. This young man had been diagnosed with borderline personality disorder, where he exhibits a lack of self-control and violent behaviors during his attempts to self-regulate.  Based on his diagnosis, he is prone to have symptoms of dissociation, including loss of memory, experiences of depersonalization, and an obscure sense of reality. These dissociative states are traced back to traumatic events that occurred, as children would use this to self-regulate during stressful times. Further analysis of his symptoms, childhood, and assessment results indicate that he was not criminally responsible for the crime he committed, as his personality disorder deemed him incapable of understanding the severity of his actions. This suggests that there is a connection between borderline personality disorder and childhood trauma, as dissociative symptoms lead to aggression or criminal behavior.

Limitations of the study

In forensic psychiatry, the assessment of criminal responsibility, social dangerousness, and the risk of recidivism are essential areas of focus. Upon an individual attempting to plead insanity in their defense, different criteria have to be met. However, there is an overall agreement that a person having an impaired mental state does severely impact their accountability for criminal behavior and how much of a threat they are to the public. A study that was conducted analyzed the different characteristics of a defendant and found that clinicians deeming them not criminally responsible is linked to having a psychiatric history and psychiatric disorders. Those who are thought to be dangerous to society are more likely to have a disorder on the schizophrenia spectrum or a personality disorder like Borderline Personality and Antisocial Personality Disorder (ASPD). It is essential for clinicians and researchers to accurately assess a defendant’s mental state as it can determine how safe the public will be with their presence and the type of support they should receive.  

Forensic Psychiatry and Criminal Responsibility

The LS/CMI is an interview that surrounds an offender’s risk factors, criminogenic necessities, and how responsive they are. Within this interview are 11 different sections. The first section assesses the defendant’s risk of reoffending by looking at areas such as criminal history, education/employment, leisure time, and more. Based on the LS/CMI results, it was concluded that the study’s defendant of focus was at a high risk of reoffending. The areas with high-risk levels were education/employment, family/marital, and companions. When looking back at his history, his education was negatively impacted when he ended up not finishing school due to being incarcerated and never having the ability to obtain a job. In terms of family and marital, his father had a criminal record, and his mother had chronic psychosis. He was also a witness to domestic violence that was occurring in the house with his mother and her partners. Lastly, the defendant has interactions with those who were involved in criminal behaviors while being incarcerated and says he has no friends. These subcomponents summarize his mental illness and the symptoms he has based on the effects of the experiences.
