On March 22, 2017, the Supreme Court overturned the Tenth Circuit’s decision and unanimously ruled that schools must offer IEPs that enable children to make meaningful academic progress. The “merely more than de minimis” standard was no longer an appropriate standard for determining if a child was receiving FAPE.
