Despite the open misuse of asset forfeiture and growing concerns over the erosion of 4th Amendment rights, Section 6077 was quietly appealed in the 1990 Defense Appropriate Bill and never took affect.

In addition to the admissions made during the hearings over Section 6077, it is important to note that asset forfeiture can occur without a successful arrest or prosecution. To get seized property back, the owners must prove their innocence of both wrongdoing and knowledge of wrongdoing if someone else is accused, rather than law enforcement proving guilt, which is a tall and expensive order.
