Consider the following scenario: For several decades, a large manufacturing firm knowingly contaminated a local water supply with a chemical byproduct, fully aware of the severe health risks it posed. The local residents, however, were not aware of these dangers. Furthermore, there were no clearly established laws defining either the firm's right to discharge the chemical or the residents' right to uncontaminated water. The issue was eventually resolved through a large-scale lawsuit involving thousands of residents, rather than a private, negotiated agreement.
