Short Answer

Enforceability of a Software Development Agreement

A company signs a contract with a freelance developer. The contract states the developer must: 1) Deliver a completed mobile application by December 1st, and 2) Ensure the application has a 'user-friendly and intuitive design'. The developer delivers the app on time, but the company is unhappy with the design and refuses to pay, claiming the contract was breached. From a legal perspective, which of the two clauses is a court more likely to enforce, and why? Explain your reasoning based on the concept of verifiability.
