Evaluating Alternative Legal Frameworks for Workday Changes

Consider two different legal frameworks governing changes to a standard workday.

Framework A: The workday can be extended only if both the employer and the employee voluntarily and mutually agree to the new terms. If no agreement is reached, the standard workday remains in effect.

Framework B: An employer has the right to unilaterally extend the workday by up to two hours, provided they pay the employee a legally mandated premium of 50% above their normal hourly wage for the extra time.

Evaluate which of these two frameworks is more likely to ensure that any change from the standard workday results in an outcome where both parties consider themselves better off. Justify your reasoning by analyzing the incentives and constraints each framework places on the parties.
