Evaluating Efficiency and Equity in Bargaining

A chemical plant's potential operations would pollute a river, harming a downstream community that has the legal right to clean water and can thus prevent the plant from opening. After negotiations, an agreement is reached: the plant operates at the economically efficient level (where the marginal benefit of production equals the marginal cost of pollution), and the plant transfers its entire profit from this operation to the community.
