Evaluating Legal Principles for Externalities

A judge is presiding over a dispute between a cattle rancher, whose herd wanders and damages the crops of a neighboring farmer. The judge considers two legal principles for assigning the cost of building a fence: 1) The 'Polluter Pays Principle,' which would require the rancher to pay for the fence because their cattle are causing the damage. 2) The 'Least Cost Avoider Principle,' which would assign the cost to whichever party can build the fence more cheaply. Critically evaluate these two principles from the perspective of an economist focused solely on achieving the most efficient outcome. In your evaluation, explain which principle aligns with this economic perspective and why the other does not, regardless of any considerations of fairness.
