Example: Miyoko and Human Resources

Miyoko, an Asian American woman with chronic pain and chronic fatigue, learned that someone in human resources at her university had tried to investigate her medical issues by searching for Miyoko online. The HR representative tried to claim that videos of Miyoko raising her arms overhead or performing light physical activity were inconsistent with Miyoko's medical documentation from her doctor, even though the video had been posted when Miyoko was on medical leave and was in a time when she was more wholly focused on recovery. Miyoko hired a lawyer to see if she could legally fight to be accommodated however, after months she returned back to work without accommodations and left her tenured job by the end of the semester because of being debilitated by having to fight to be accommodated.
