Following the Supreme Court decision, an IEP is required to reasonably calculate goals that are measurable, challenging, and ambitious for a student’s individual circumstances.

In 2017, the Supreme Court unanimously ruled that children with disabilities were entitled to more than “de minimis” of educational benefit under FAPE. This expanded the educational rights previously established under Board of Education v. Rowley.

Endrew and FAPE: Concepts and Implications for All Students With Disabilities

Endrew was a child with autism who attended public school in the Douglas County School district from kindergarten through fourth grade. In April 2010, Endrew’s parents rejected the 5th grade IEP proposed by the Douglas County School District, as they viewed it to be the same as previous IEPs, where little progress had been made in Endrew’s academic and functional achievements. Endrew was then pulled out and enrolled in private school, where his behavior and academics significantly improved. Seeing this success, Endrew’s parents pursued tuition reimbursement for the cost of private school placement from the Douglas County School District.
