Any effort to promote access and inclusion does not reduce the impact of the failures T-Mobile made. This is because the failures are the most basic assistance a company in a position such as T-Mobile can provide to individuals with disabilities. In addition, T-Mobile provided no evidence that would support their claim and no precedents could be located.

Rather than disputing the claims regarding the violation of the law, T-Mobile submitted a request to reduce the $819,000 USD forfeiture. They requested it be reduced by 50% and the reasoning they provided was that the fine was inequitable, the commission must consider how T-Mobile asserts they are “a leader in the disabilities access arena”, and how the company “made a good faith effort to comply” prior to the investigation. The request was ultimately denied.
