Unenforceability of Subjective Job Performance

A contractual requirement for an employee to perform a task with a 'pleasant manner' illustrates an unenforceable term. For example, a court would find it nearly impossible to objectively judge whether a waiter had 'smiled enough' to fulfill their contractual duty. Because such subjective performance qualities are not verifiable, they cannot be reliably enforced in court.
