Examples of Bona Fide Occupational Qualifications (BFOQs)
Legally permissible BFOQs include hiring an individual of a particular faith for a leadership role in a religious institution, setting a mandatory retirement age for airline pilots for safety reasons, and hiring only male guards for a male prison. Due to privacy concerns, gender can also be a BFOQ for positions like nursing or custodial staff in gender-specific facilities. Conversely, a BFOQ claim may fail, as when Pan American World Airways was not permitted to hire only female flight attendants, because hiring men would not undermine the essence of its business.
