Subpart D of Section 504 for Title 32

Juvenile justice rehabilitation centers are required to meet FAPE standards for all students with disabilities in these facilities. This also means they are required to comply with standards provided in section 504 regarding how to properly handle misconduct that is related or caused by a students disability.

Michigan State University

The title that includes all concepts related to education. This includes the Department of Education and additional organizations.

United States Title 34

29 U.S.C. § 794 (2018). Provides protection of rights and forbids discrimination against people with disabilities in any agency or program that is receiving federal funds. Additionally, this section mandates accommodations for students in elementary school all the way through higher education.

The Department of Educations regulations for The Rehabilitation Act

A joint letter proposed from the Department of Education and The Department of Justice that publicly announced the failures of Juvenile Justice Residential Facilities with complying with Federal laws that protect against discrimination and are legally obligated to follow. The laws focused on are The Rehabilitation Act of 1973, IDEA, and the Americans With Disabilities Act.

This is a sub-agency under the Department of Education. They are tasked with enforcing all federal civil rights laws in all educational systems and conducting proper investigations of compliance.

This section of U.S code outlines the regulations any organization under Title 28 must follow in accordance with Section 504 of the Rehabilitation Act of 1973.

Subpart G of Part 42 from Title 28; Regulations under Section 504

FAPE was created by IDEA but it is also a large part of The Rehabilitation Act as Section 504 declares all federal agencies receiving funds are required to follow any law enacted by the federal  government. Additionally, the U.S. Code of Federal Regulations also requires each title to implement and follow additional regulations specific to their area in accordance with all public laws. This means because United States Title 34 executes supplementary laws relevant to their title and are federally funded, they are allowed to establish their own guidelines for FAPE according to Section 504. 

The reason the Rehabilitation Act of 1973 must follow FAPE from IDEA

Section 504 of the Rehabilitation Act (29 U.S.C. § 794) requires that the housing owner/landlord is required to pay for any accommodations as well as fix them. The exception is that if the person demonstrates that providing payment for this would be a burden. Section 504 and the ADA requires that governmental bodies will be financially responsible for accommodations for public housing and other federally assisted provided housing, 24 C.F.R. part 8, 24 C.F.R. part 9. 

Payment for Reasonable Accommodation

Section 504 of the Rehabilitation Act details the provision of equal opportunities to students with disabilities to participate in college-sponsored activities and academic accommodations, often provided by campus disability services offices. However, not much has been studied concerning the effectiveness of such provisions in facilitating the success of college students with disabilities.
