Understanding Lien Waivers in Electrical Contracting

A lien waiver is a signed statement that tells an owner or contractor the signer will not pursue a mechanic's lien for a stated payment amount. In electrical work, the upstream contractor may ask for a waiver before issuing progress money or the last check on a job. A conditional waiver becomes effective only after the payment is actually received and processed, while an unconditional waiver works as soon as it is signed. State laws may also require specific language or official forms, so the paperwork can differ from one jurisdiction to another. For that reason, an electrical contractor should not sign an unconditional final waiver until the funds have fully cleared the bank.
