بدان که خرقه کردن جامه اندر میان این طایفه معتاد است و اندر مجمع های بزرگ که مشایخ بزرگ رضی عنهم حاضر بودند این کرده اند. و من از علما دیدم گروهی که بدان منکر بودند و گفتند که: «روا نباشد جامهٔ درست پاره کردن و آن فساد بود.»
و این محال است. فسادی که مراد از آن صلاح باشد سهل بود و همه کسان نیز جامهٔ درست ببرند و بدوزند؛ چنان که معهود است و هیچ فرق نباشد میان آن که جامه ای به صد پاره کنند وبر هم دوزند و میان آن که به پنج پاره کنند واندر هر پاره ای از آن خرقه راحت دل مؤمنی است و قضای حاجتی که از آن وی بر مرقعه دوزند.

و هرچند که جامه خرقه کردن را اندر طریقت هیچ اصلی نیست و البته اندر سماع در حالت صحت نشاید کرد؛ که آن جز به اسراف نباشد اما اگر مستمع را غلبه ای پدیدار آید چنان که خطاب از وی برخیزد و بی خبر گردد معذور باشد؛ یا چون یکی را چنان افتد، اگر جماعتی بر موافقت وی خرفه کنند روا باشد و جمله خرق اهل این طریق بر سه گونه باشد: یکی آن که درویش خود خرقه کند و آن اندر حال سماع بود به حکم غلبه و آن دو گونه: یکی آن که جماعت و اصحاب به حکم پیری و مقتدایی جامهٔ وی را خرقه کنند و یا اندر حال استغفار از جرمی و دیگر اندر حال سکر از وجدی.
و مشکل ترین این جمله خرقهٔ سماعی باشد و آن بر دو گونه باشد:

یکی مجروح و دیگر درست و جامهٔ مجروح را شرط دو چیز بود: یا بدوزند بدو باز دهند این جماعت یا به درویشی دیگر، و یا مر تبرک را پاره پاره کنند و قسمت کنند.
اما چون درست باشد بنگریم تا مراد آن درویش مستمع که جامه بیفکند چه بوده است. اگر مراد، قوال بوده است وی را باشد و اگر مراد، جماعت،ایشان را و اگر بی مراد افتاد، به حکم پیر باشد تا چه فرمان دهد پس اگر درویش را در آن مرادی بوده باشد به هر نوع که بود از راه موافقت جماعت شرط نباشد؛ از آن چه به هر حال که باشد یا به مرادی یا به اضطراری دیگران را اندر او هیچ موافقت نیست. فاما اگر مراد درویش جماعت بود یا بی مراد درویش جدا شده است، موافقت اصحاب با یک دیگر شرط باشد؛ بی موافقت جمله درست نیاید. و چون جماعت موافقتی کردند بر چیزی، پیر را نشاید که به قوال دهد جامهٔ درویشان؛ اما روا بود اگر محبی از آن ایشان چیزی فدا کند و جامه به درویشان باز دهد و یا همه خرقه کنند و قسمت کنند.

و اگر جامه اندر حال غلبه افتاده بود مشایخ اندر این مختلف اند بیشتری گویند قوال را باشد، بر موافقت قول پیغمبر، علیه السلام:«من قتل قتیلا فله سلبه. جامهٔ مقتول قاتل را بود.» و اگر به قوال ندهند از شرط طریقت بیرون آیند و گروهی گویند: فرمان پیر را باشد و اختیار این است؛ چنان که آن جا به مذهب بعضی از فقها جز به اذن امام جامهٔ مقتول قاتل را ندهند، این جا جز به فرمان پیر جامه به قوال ندهند و اگر پیر خواهد که به قوال ندهد بر وی حرج نباشد. والله اعلم بالصواب و الیه المرجع و المآب.

English translation

Know that tearing the garment into a frock (khirqa) is customary among this group, and in the great gatherings where the great shaykhs (may God be pleased with them) were present, they did this. And I saw among the scholars a group who denied it and said: 'It is not permissible to tear a whole garment, and that is corruption (fasad).'

And this is absurd. A corruption whose intent is betterment is a trivial matter, and all people likewise cut whole garments and sew them, as is customary; and there is no difference between one who cuts a garment into a hundred pieces and sews them together and one who cuts it into five pieces, and in each piece of that frock is the comfort of a believer's heart and the fulfillment of a need, for the sake of which they sew it onto the patched frock (muraqqa').

And although tearing the garment into a frock has no basis (asl) in the [Sufi] path, and it certainly must not be done during audition (sama') in the state of sobriety, for that would be nothing but extravagance (israf) — yet if an overwhelming state (ghalaba) appears to the listener such that discourse departs from him and he becomes unaware, he is excused; or when this befalls one, if a group tears [their garments] in agreement with him, it is permissible. And all the tearing of garments of the people of this path is of three kinds: one is that the dervish tears his own garment, and that is in the state of audition by virtue of an overwhelming state; and [the others are] two types: one is that the community and companions tear his garment by virtue of [his being] an elder and exemplar (pir and muqtada), or in the state of seeking forgiveness for a sin, and the other in the state of intoxication (sukr) arising from an ecstasy (wajd).

And the most difficult of all these is the audition-frock (khirqa-yi sama'i), and that is of two kinds: one wounded (majruh) and the other whole (durust). And the garment of the wounded kind has two conditions: either they sew it and give it back to this group or to another dervish, or they tear it into pieces for the sake of blessing (tabarruk) and distribute it.

But when it is whole, we look to see what the intent of that listening dervish who cast off the garment was. If the intent was the singer (qawwal), it is his; and if the intent was the community, it is theirs; and if it fell without intent, it is by the ruling of the elder (pir), whatever he may command. Then if the dervish had some intent in it, in whatever manner it was, the agreement (muwafaqat) of the community is not a condition; because in any case, whether by intent or by compulsion, others have no share in it. But if the dervish's intent was the community, or the dervish became separated [from the garment] without intent, then the agreement of the companions with one another is a condition; without the agreement of all it is not valid. And when the community has agreed upon something, it is not proper for the elder to give the dervishes' garment to the singer; but it is permissible if a devotee (muhibb) among them ransoms (fida) something and gives the garment back to the dervishes, or they all tear it and distribute it.

And if the garment fell in the state of overwhelming [ecstasy], the shaykhs differ on this. Most say it belongs to the singer, in agreement with the saying of the Prophet, peace be upon him: 'Whoever slays a slain one, his spoils are his (man qatala qatilan fa-lahu salabuhu)' — the garment of the slain belongs to the slayer. And if they do not give it to the singer, they step outside the condition of the path. And a group says: it belongs to the command of the elder, and this is the [preferred] choice; just as there, according to the doctrine of some of the jurists, they do not give the garment of the slain to the slayer except by the permission of the imam, here they do not give the garment to the singer except by the command of the elder. And if the elder wishes not to give it to the singer, there is no blame (haraj) upon him. And God knows best what is correct, and to Him is the return and the final destination.
